• The Platform includes three interconnected properties:

  • LowEndTalk.com: Community discussion forum.

  • ServerVerify.com: Benchmarking, review, and hosting provider profile system.

• Content and data may be shared, cross-posted, aggregated, reformatted, or otherwise reused across the three properties. For example, a review on ServerVerify may appear in a LowEndBox article or in a LowEndTalk thread, and vice versa.

• All sites are operated as one integrated ecosystem by WNY IT Services Inc.

2. User Accounts and Registration

• UNDER ALL CIRCUMSTANCES LOWENDBOX, LOWENDTALK AND SERVERVERIFY MAKES NO REPRESENTATION, WARRANTY OR CONDITION, EXPRESS OR IMPLIED, AND EXPRESSLY EXCLUDES ALL IMPLIED OR STATUTORY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, DURABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR TITLE OR NON-INFRINGEMENT AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. ANY AND ALL USERS OF LOWENDBOX AND LOWENDTALK ASSUME ALL LIABILITY PERTAINING TO THE USE OF THE WEBSITES IN ANY AND ALL MATTER OR CIRCUMSTANCE.

13. Limitation of Liability

To the fullest extent permitted by law:

• WNY IT Services Inc. shall not be liable for any damages, including direct, indirect, incidental, consequential, or punitive damages.

• This includes loss of profits, data, service interruption, or reputational harm.

• USER ACKNOWLEDGES THAT LOWENDBOX, LOWENDTALK AND SEVRERVERIFY SHALL HAVE NO LIABILITY FOR ANY DAMAGES, COSTS, OR LOSSES INCURRED BY USER (OR ITS CLIENTS, PROVIDERS, VENDORS, OR ANY OTHER PARTY) CAUSED BY ANY ACTION OR INACTION OF LOWENDBOX OR LOWENDTALK. THE LIMIT OF LOWENDBOX’S AND LOWENDTALK’S LIABILITY IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR BY STATUTE OR OTHERWISE TO CUSTOMER (OR ITS USERS, CLIENTS, PROVIDERS, VENDORS OR ANY OTHER PARTY) CONCERNING PERFORMANCE OR NON-PERFORMANCE IN ANY MANNER RELATED TO THIS AGREEMENT OR THE USE OF THE WEBSITES, FOR ANY AND ALL CLAIMS SHALL NOT, IN THE AGGREGATE, EXCEED $1. IN NO EVENT SHALL LOWENDBOX OR LOWENDTALK BE LIABLE FOR ANY LOST PROFITS, SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES.

14. Indemnification

You agree to indemnify and hold harmless WNY IT Services Inc., its affiliates, employees, and contractors from any claim, liability, or expense arising from your use of the Platform, your User Content, or your violation of these Terms.

15. Children¡¯s Privacy

• The Platform is not directed to children under 13.

• We do not knowingly collect data from children under 13. If discovered, such accounts will be deleted.

16. Governing Law and Jurisdiction

• These Terms are governed by the laws of the State of New York, USA.

• Any dispute shall be resolved in the state or federal courts of Erie County, New York.

• You waive any right to a jury trial or class action.
